Does my baby get Canadian citizenship if born in Canada?
Yes. Canada applies jus soli: with a narrow exception for the children of accredited foreign diplomats, anyone born on Canadian soil is a Canadian citizen from birth, whatever the parents' nationality or immigration status. The child is entitled to a provincial birth certificate and then a Canadian passport.
How the citizenship is evidenced
- The hospital registers the birth with the province; you complete the registration.
- The province issues a birth certificate — this is the proof of Canadian citizenship for a child born in Canada.
- With that certificate, you apply for a Canadian passport for the child.
There is no separate citizenship certificate to apply for and no waiting period. Both steps take weeks rather than days, which is the main thing that determines how long a family stays after the birth.
